Patrick Clancy lawsuit live updates: Patrick Clancy’s lawyer claims Lindsay’s doctors knew her mєntal health was ‘disaster waiting to happen’

A Massachusetts judge upheld grieving dad Patrick Clancy’s $1 million civil lawsuit against his 𝘬iᩚller ex-wife’s healthcare providers Wednesday — not buying the defense’s claim that Lindsay Clancy’s psychiatrist and nurse practitioner are protected from being sued because of the nature of their work.

The pivotal hearing in Dedham came less than two months after Lindsay Clancy’s murder trial for 𝘬iᩚlling her and Patrick’s three young children ended with a 𝘴h☉𝔠king hung jury.

Lindsay, 36, strangled daughter Cora, 5, and sons Callan, 3, and Dawson, 8 months, to dєatᩚh in their Duxbury home in 2023 when she was postpartum.

The former labor and delivery nurse’s defense argued at this summer’s criminal trial for her to be found not guilty by reason of insanity because she was suffering from the extremely dangerous — and rare — phenomenon of postpartum psychosis combined with bipolar disorder, both of which went undiagnosed before her 𝘴h☉𝔠king crime.

Patrick, 38, claims his ex’s doctors and hospitals are to blame for “overmedicating” her when she sought treatment. The seven-week-long murder trial established that Lindsay had been prescribed a cocktail of 13 potent psychiatric drugs in the months before the tots’ deaths.

Live updates have ended, but keep reading to catch up on Wednesday’s hearing in Patrick Clancy’s $1 million lawsuit:

Judge Michael Doolin said he’d rule at a later date on a bid to toss out Patrick Clancy’s $1 million wrongful dєatᩚh suit.

“I thought it was very well argued by all three of you. I thought you all did an excellent job,” Doolin said.

“Thank you all. I’ll take it under advisement,” the judge later added.

Patrick Clancy’s lawyer, Howard Cooper, said the mєntal health of his wife, Lindsay Clancy, “was a disaster waiting to happen.”

Patrick is suing her shrink and a nurse practitioner for malpractice which he claimed contributed to Lindsay cracking and 𝘬iᩚlling her kids.

“These doctors were on notice that this was a disaster waiting to happen and they mismanaged the medication, they mismanaged the treatment, they failed to engage in proper treatment, they prescribed drugs without coordination and some of those drugs were absolutely contraindicated,” Cooper argued.

Patrick Clancy’s lawyer, Howard Cooper, said he expects Lindsay Clancy to testify in Patrick’s wrongful dєatᩚh lawsuit once her criminal case for strangling their three kids wraps up.

“Once her 5th Amendment issues are resolved one way or the other, she will testify that she told these defendants explicitly that she had homicidal ideation [and] that she was worried about something awful happening to her kids,” Cooper said.

“I can’t imagine a more explicit threat,” the lawyer said. “Defendants seem to think that you need to have a date, time, place and manner that the threat is going to be delivered.”

Earlier in the arguments, defense lawyers for the healthcare providers Patrick is suing claimed there wasn’t any evidence Clancy ever told them she thought about hurting the kids.

They are claiming her providers are protected by legal immunity that covers doctors, nurses and hospitals.

Patrick Clancy’s lawyer, Howard Cooper, blasted the lawyers trying to dismiss his $1 million wrongful dєatᩚh suit for making “closing arguments” at such an early stage of the case.

“What you just heard is a closing argument, Your Honor. Completely inappropriate at this stage,” Cooper said.

“The complete mismanagement of Lindsay Clancy’s mєntal health care became the substantial cause of her murdering her three children,” Cooper said.

A lawyer for psychiatrist Dr. Jennifer Tufts, who treated Lindsay Clancy before she strangled her kids, claimed the alleged 𝘬iᩚller mom never shared with the shrink she thought about harming her kids.

Mary Azzarito, an attorney for Tufts, said the evidence indicates Clancy only confessed to her dark thoughts to her mom and husband.

“She told her mother, she told her husband,” Azzarito said. “There is no clear evidence that she told her providers.”
