The October 23 Hearing in Christa Pike’s Lawsuit Against Attorney General Jonathan Skrmetti Vanishes From the Calendar After Both Sides Agree No Oral Arguments Are Needed

A chancery court hearing that had been set for October 23 in the case of Christa Gail Pike versus Tennessee Attorney General Jonathan Skrmetti was formally removed from the docket after both parties waived oral arguments. Court documents show that the session concerned the state’s motion to require Pike to amend her complaint. With the waiver in place, the chancellor is left to decide the motion on the written papers alone. The cancellation comes in the middle of a much larger legal fight that began months before the September 30 exє𝔠uti☉n attempt.

Pike’s attorneys originally filed a complaint in January 2026 arguing that Tennessee’s then-new single-drug pentobarbital protocol was untested and carried a substantial risk of unnecessary pain, suffering, and terror. That lawsuit was still active when the state proceeded with the exє𝔠uti☉n date. After the procedure failed and Pike was hospitalized, her lawyers asked the court for permission to amend the complaint so it could include the concrete details of what happened on September 30. The court later granted her additional time, extending the ᴅᴇᴀᴅline for the amended filing into late January 2027 because of her ongoing medical condition. The October 23 date that was canceled had been the setting in which those procedural issues were expected to be argued. Instead, the chancellor will now rule without a hearing. Pike was convicted in 1996 of the 1995 murder of classmate Colleen Slemmer.

She was 18 at the time of the crime. The state had sought to make her the first woman executed in Tennessee in roughly 200 years. On the night of the scheduled exє𝔠uti☉n, after earlier court stays were lifted by the U.S. Supreme Court, officials administered two full doses of pentobarbital. Media witnesses later reported that she remained alive and was still breathing. Emergency medical personnel were called, and she was transported to a hospital where she stayed unconscious and ventilated for days. She regained consciousness around October 6, was discharged on or about October 10, and returned to the Debra K. Johnson Rehabilitation Center. Her attorneys have described severe injuries to her arms and a prolonged period of cognitive confusion after she woke.

In early October they obtained a court order requiring the Tennessee Department of Correction to preserve all evidence related to the failed exє𝔠uti☉n, including drugs, syringes, IV equipment, communications, and records of the 911 call that brought emergency responders to the prison. The case remains pending in Davidson County Chancery Court before Chancellor I’Ashea Myles. No new exє𝔠uti☉n date has been scheduled while the governor’s independent review of the protocol continues. Pike’s legal team has also filed a separate emergency motion seeking to end her isolation in the prison infirmary, arguing that the arrangement violates an earlier settlement agreement. As of the end of October 2026 the central lawsuit challenging the lєthaℓ-inje𝔠ti☉n method is still moving forward, now with the added factual record of an actual failed attempt that left the inmate alive after two doses of the drug the state intended to use to k*ll her.
