Charges Against Gary Siders Sr. Dismissed in Vinton County Child Endangerment Case After Competency Ruling

The criminal case against 73-year-old Gary Siders Sr. has been formally dismissed, marking a significant development in the ongoing legal proceedings connected to the discovery of 16 children living in severe conditions in a rural Ohio home. On October 6, 2026, Vinton County Common Pleas Judge Laina Fetherolf Rogers entered an order ending the prosecution against the eldest defendant in the case.

Siders had been charged with 16 counts of endangering children — ten felonies and six misdemeanors — after authorities removed the children from a residence on Ohmer Street in Hamden on June 30, 2026. The children, ranging in age from approximately 18 months to 18 years, were found in an environment that officials described as unsanitary and unhealthy. Siders is the paternal grandfather of the minors. His wife, Christina Siders, their son Gary Siders Jr., and daughter-in-law Elizabeth Siders were also arrested and charged in connection with the same events.

The decision to dismiss the charges followed a September 9 court hearing at which attorneys on both sides agreed that Siders was not mentally competent to stand trial. A psychological evaluation had determined that he could not adequately understand the proceedings or ᴀssist in his own defense. His attorney, Dorian Baum, has publicly described his client as experiencing significant cognitive decline, including memory problems, difficulty answering questions, and an inability to grasp the nature of the accusations against him. Baum has indicated that the condition appears progressive and is not expected to improve in a way that would allow a criminal trial to proceed.

The dismissal was entered without prejudice, a legal designation that leaves open the possibility of refiling charges at a later date. In practical terms, however, Baum has stated that a return to prosecution is highly unlikely given the extent of his client’s mєntal limitations. The court is retaining jurisdiction over Siders so that civil commitment proceedings can be initiated in probate court if necessary. This process would focus on determining whether he requires placement in a treatment or residential care setting rather than remaining subject to criminal prosecution.

Siders had already been released from jail earlier in the case after a fall while in custody revealed a serious medical condition. Concerns about the cost of his ongoing medical care had also played a role in earlier bond decisions. His attorney and family members have referenced a history of stroke and progressive mєntal decline as contributing factors to his current state.

While the case against the grandfather has ended, the legal proceedings involving the other three adults continue. Gary Siders Jr. and Elizabeth Siders, the parents of the 16 children, along with Christina Siders, the grandmother, still face multiple felony child endangerment charges. Attorneys for all three have requested psychological evaluations. In early October, Christina Siders’ counsel asked the court to allow a neuropsychologist to examine her, noting that some of her symptoms could be consistent with dementia and might affect whether her case can move forward.

The discovery of the children in late June prompted a strong response from local and state authorities. Officials described the living conditions as among the most severe they had encountered and emphasized that the primary priority remained the health, safety, and long-term placement of the minors. The children were placed in the temporary custody of child-welfare agencies and received medical evaluations following their removal.

As of early October 2026, the dismissal of charges against Gary Siders Sr. removes the oldest defendant from the criminal process. The remaining cases are still in the early stages, with competency evaluations pending and further court hearings expected in the coming months. The focus of investigators and child-protection authorities continues to center on the welfare of the 16 children and the resolution of the charges still pending against the other family members.
