The chilling final video of a Louisiana student filmed moments before she was allegedly gang-raped and killed “cuts like a knife,” according to her mom’s lawyer.

Footage filmed on the night of Madison Brooks’ death in Baton Rouge shows the heavily intoxicated teen, 19, seemingly arguing with her alleged attackers inside a vehicle. The cheerleader was allegedly gang-raped in the car before stumbling into oncoming traffic and dying of traumatic injuries. One of her alleged attackers is facing trial this month.

Defense attorneys argued at the time that the footage exonerates their clients. They insist Brooks participated in consensual sexual activity with two of the men and was not assaulted. Prosecutors argue that Brooks was too intoxicated to give consent. Toxicology reports showed that Brooks had a blood alcohol level of .319, nearly four times the legal drink driving limit. Brooks .

The family has since criticized the decision to release the video from inside the car. Kerry Miller, representing Brooks’ mom, characterized the video as “hurtful and shameful,” and noted that every time the defense releases another brief clip, it “cuts like a knife” into his client.

“It’s one thing to defend your clients. It’s another to try the case in the media,” Miller said. “It shows a level of desperation.”

The video from 2023 shows Brooks appearing to slur her words during what appears to be an argument with the car’s occupants.

Kaivon Washington and Desmond Carter, both 21, are accused of assaulting Brooks in the back seat after collecting the intoxicated student from a bar. The video, reportedly filmed by one of the defendants, was shared with WBRZ by their legal representation.

“I’m sorry that I offended you that bad,” Brooks can be heard saying from the center rear seat. “Take her home,” one of the men says off-camera.

“Get out, get out. I will Uber on my own,” she tells the man beside her, who steps out of the vehicle to let her exit. “I’m sorry that your feelings got hurt,” Brooks says in the brief video.

Carter, whose trial begins later this month, Washington and Casen Carver – the driver of the car – are all charged with rape.

A fourth man, Everett Lee, was also riding in the vehicle that night, according to arrest documents. He was detained by cops after Brooks’ death but a grand jury in his case chose not to hand down charges.
